The customer declares to agree, without reservation, to the content of our general and special terms and conditions as stated below.
ART. 1: SCOPE OF APPLICATION
The following general terms and conditions apply to all agreements concluded by the customer with DBP Plastics NV, the company, with its registered office at Terbekehofdreef 25-29, 2610 Wilrijk, Belgium.
Within the framework of these general terms and conditions, customers refer to consumers of Amuse products, the brand of DBP Plastics NV.
Website: www.amuseyourday.com, the website of the Amuse brand of the parent organization DBP Plastics NV.
A consumer is a natural person who, when concluding an agreement, is not acting in the context of his commercial activity or other self-employed economic activity.
Distance contract is any agreement between DBP Plastics NV and the buyer regarding food packaging products or services that are concluded within the framework of a system organized by the supplier for distance selling or service provision whereby, for this agreement, exclusive use is made of one or more distance communication techniques up to and including the conclusion of the agreement itself.
Distance communication technique: any means that, without the simultaneous physical presence of DBP Plastics NV and the buyer, can be used for the conclusion of the agreement between these parties.
All agreements are subject to and interpreted in accordance with Belgian law.
General terms and conditions used by the buyer do not apply, unless expressly agreed to by DBP Plastics NV.
DBP Plastics NV reserves the right to change and/or supplement the general terms and conditions at any time for future orders.
ART. 2: CONCLUSION OF THE AGREEMENT, LANGUAGE OF THE AGREEMENT, ORDER STEPS, STORAGE OF THE AGREEMENT
The presentation of goods on the internet does not mean that a binding agreement has been concluded with DBP Plastics NV. The agreement between customers and DBP Plastics NV is concluded when DBP Plastics NV accepts an order from a customer. Confirmation of the order received does not mean that the order has been accepted. In that case, DBP Plastics NV sends an order confirmation via e-mail. Sending the ordered goods to the customer means that the order has been accepted.
The language of the agreement is Dutch.
The customer can place an order in the Amuse webshop by following these steps:
By clicking on the product of your choice and adding it to the shopping cart. The customer can view all items placed in the shopping cart by clicking on 'your shopping cart' or 'view your shopping cart'. Here the customer can remove items, change the quantity and view the shipping costs.
When the customer wants to buy the items in the shopping cart, he or she clicks on 'order' to go to the ordering process.
Customers who have already registered with Amuse and have not yet logged in can log in with their login details. New customers are asked to enter their order details and log in or continue as a 'guest'.
Via the 'register' or 'log in' or 'continue as guest' button, the customer proceeds to the payment methods. Here the customer can choose from different payment methods.
Before the order is sent, the customer, after clicking on 'continue', first arrives on the control page. On this page, all data (in particular invoice and delivery address, product, price, quantity, payment method of the order) are displayed again in an overview. The data can now be corrected or changed.
The order is sent via the 'order now' button. With this, the customer concludes a binding purchase agreement. More information about the time of the conclusion of the agreement can be found under the first paragraph of this point. More information about the ordering process can be found on the 'help and support' page.
The agreement is not stored by DBP Plastics NV and can no longer be accessed by the customer after the ordering process has been completed. The order data and the right of withdrawal are added in text form to the order confirmation, which can be printed after receipt by e-mail. DBP Plastics NV stores the customer's order data. If the customer loses the documents of his order, he can contact DBP Plastics NV in writing, by telephone or by e-mail. DBP Plastics NV will then send a copy of the order data to the customer.
The consumer is the end consumer and may not be resold in any way.
ART. 3: PAYMENT CONDITIONS
The customer can pay by bank contact, via PayPal or with a credit card.
If the issuer of your card refuses to agree to your payment to us, we cannot be held responsible for delays in delivery or non-delivery of your order. Orders without valid payment in the name of the registered cardholder will not be accepted or processed. Please note: minors (under 18 years of age) may not make a purchase unless they have permission from their parents or guardian.
Payment via credit card with SecureCode
If the customer chooses to pay by credit card with SecureCode (American Express, Visa and MasterCard), the goods will be sent directly to the customer. The money will be debited from the credit card after the order confirmation has been sent to the customer.
Payment via PayPal
The order will be sent no later than two working days after the amount has been transferred to PayPal.
ART. 4: PRICES AND SHIPPING COSTS
The prices at the time of the order apply. All prices given are in euros (€) and are gross prices, i.e. the prices include VAT and other price components and exclude shipping costs. A minimum order amount of €30 applies.
The amount of delivery and shipping costs are calculated from the location of the logistics partners of DBP Plastics NV. If goods are sent to a customer outside Belgium, the delivery and shipping costs increase based on weight or volume weight.
For shipments outside the EU, additional costs such as taxes and/or levies/import duties may arise that the customer must bear himself.
ART. 5: DELIVERY AND SHIPPING CONDITIONS
Ordered goods will be delivered as soon as possible in accordance with the requested delivery method to the specified address. Incorrectly provided delivery addresses are the responsibility of the user and may give rise to additional costs that will be charged to the user. All delivery costs are subject to change without notice. All goods are delivered subject to their availability. The maximum delivery period is fourteen days, counting from the day after your order.
If we are unable to deliver your goods within fourteen days, we will inform you as soon as possible and inform you of the expected delivery date. If we are unable to deliver our products due to a storage error, shortage or any other unforeseen circumstance, your order will be canceled and we will inform you of this. This will be followed by a refund of the canceled product(s). If we are unable to deliver the goods within fourteen days, you can also cancel the undelivered orders/products yourself at any time after the notification of a late delivery. If the payment has already been made, you will receive the full refund.
If the goods delivered by us were damaged during transport, do not correspond to the articles mentioned on the delivery note or do not correspond to the articles you ordered, you must report this and return the articles to us within fourteen calendar days of receipt. If we do not receive such notification, the customer is deemed to have accepted the articles as satisfactory. We cannot be held responsible for any consequential damage due to late delivery or non-delivery by the carrier appointed by the company. In such cases, our liability remains limited to the value of the articles that are proven not to have been received by the customer.
ART. 7: DISTANCE SELLING REGULATIONS/RIGHT OF WITHDRAWAL
In accordance with the distance selling regulations, you have the right to cancel or return any order placed via the website within 14 calendar days, counting from the day after the delivery date. This does not apply to items that have been personalized at your request.
To cancel an item, you can send us, DBP Plastics NV, Terbekehofdreef 25-29, 2610 Wilrijk, an unambiguous statement by e-mail to info@amuseyourday.com stating that you wish to make use of your right of withdrawal. You must also state your customer number and the order number of the order.
During the first 14 days after delivery, we expect you to handle the order and packaging with care. If you still want to be able to return the goods, you may only unpack or use them to the extent necessary to assess whether you wish to keep the goods. We would like to ask you to return the goods in the original packaging.
All items are returned at the customer's expense. For products that are damaged or incorrectly delivered upon delivery, we will refund the costs upon receipt of the items.

ART. 8: RETENTION OF TITLE
The goods remain the property of DBP Plastics N.V. until DBP Plastics N.V. has received full payment, including reimbursement of interest and costs.
The buyer may not encumber, sell, resell, dispose of or otherwise encumber the products before ownership has passed.
ART. 9: FORCE MAJEURE
We are not responsible for the non-fulfillment of our obligations if this is the result of, or is caused by, labor disputes or any other circumstances that are reasonably beyond the control of the company, such as cases of force majeure, riot and civil unrest, flood, fire, technical malfunctions, strike, lockout, unexpected traffic jams, problems finding transport and the enactment of laws. If, due to such circumstances, it becomes impossible for the company to deliver the ordered items in whole or in part within a reasonable period of time, the liability of DBP Plastics N.V. is limited to the value of the undelivered items, plus any associated delivery costs.
ART. 10: WARRANTY
With regard to the delivery of consumer goods, we apply the statutory minimum warranty period of two years if the goods do not comply with the placed order. This means that in the event of defects or defects in the good, a free repair or replacement is possible up to two years after delivery.
Insofar as this is possible and reasonable, you have the choice between repair or replacement. Only if the repair or replacement is excessive or impossible or cannot be carried out within a reasonable period of time, you have the right to demand a price reduction or the dissolution of the sales agreement.
If the defect or defect manifests itself within six months of delivery, it is deemed to have already existed before delivery, unless we can prove otherwise. After six months you will have to prove yourself that the defect was already present at the time of delivery.
In the exceptional case that the quality of the delivery is affected, the Buyer must provide proof of this immediately, directly at the time of delivery. The Buyer is always obliged to carefully inspect the products immediately upon receipt. Complaints from the Buyer relating to defects in the product or delivery that are externally visible (for example, if the products are not safe or were damaged during transport) must therefore be reported by the Buyer to DBP Plastics N.V. by e-mail. -mail to be notified and this no later than two months after receipt.
If you have received a product in a damaged condition, please let us know first. You can contact us via info@amuseyourday.com. We will see how we can offer a solution and will ask you to return the item. The return costs will be reimbursed in this case (according to the standard postal rates). You send the damaged product together with the return form and a description of the damage. Be sure to also include your account number so that we can carry out the refund.

ART. 11: LIABILITY
The website is offered to you without explicit or implicit guarantees regarding its correct operation. DBP Plastics N.V. is not liable for damage resulting from the use of the Website, regardless of whether it turned out to be correct or incorrect, nor for damage caused as a result of incorrect, incomplete, ambiguous or dated content or language errors on the Website.
DBP Plastics N.V. is in any case only liable for compensation up to the amount of the order in question.
ART. 13: DATA PROTECTION
We make every effort to protect the security of the users of our online webshop. We use SSL technology to secure your data during all sales transactions with us. All information you provide is fully encrypted so that third parties cannot read it. You can recognize a secure SSL connection by the "lock" in the bottom status bar of your browser.
ART. 14: COMPLAINTS/DISPUTE RESOLUTION
DBP Plastics NV does everything it can to satisfy its customers 100%. If the buyer has any complaints about its services and/or products, they can contact DBP Plastics N.V. by email via info@amuseyourday.com
All disputes regarding the concluded agreement are governed by Belgian law and only the Antwerp court has jurisdiction to take cognizance of them.

If we still cannot reach a solution together via our personal complaints department at info@amuseyourday.com, then you as a customer can contact Safeshops.be. Safeshops.be will mediate between you as a consumer and us, if your complaint is accepted by them. Only complaints submitted via the complaint form at https://www.safeshops.be/nl/consumers-complaints/ will be processed. In this way, the label organization immediately has all the correct information to further process your complaint.
