General terms and conditions Amuse - DBP Plastics NV (amuseyourday.com)
The customer agrees, without reservation, to the contents of our general and special conditions as stated below.
ART. 1: SCOPE
The following general terms and conditions apply to all agreements concluded by the customer with DBP Plastics NV, the company, with its registered office at Terbekehofdreef 25-29, 2610 Wilrijk, Belgium.
Within the framework of these general terms and conditions, consumers of Amuse products are understood to mean the DBP Plastics NV brand.
Website: www.amuseyourday.com, the website of the Amuse brand of the parent organization DBP Plastics NV.
A consumer is a natural person who, when concluding a contract, does not act in the course of his commercial activity or any other independent economic activity.
Distance contract is any contract between DBP Plastics NV and the buyer regarding packaging products for food or services that are concluded under a system for distance selling or services organized by the supplier, whereby, for this agreement, only a or more techniques for distance communication up to and including the conclusion of the agreement itself.
Technology for distance communication: any means that, without the simultaneous physical presence of DBP Plastics NV and the buyer, can be used to conclude the agreement between these parties.
All agreements are subject to and interpreted in accordance with Belgian law.
General terms and conditions that the buyer uses do not apply, unless expressly agreed to by DBP Plastics NV.
DBP Plastics N.V. reserves the right to change and / or supplement the general terms and conditions at any time for future orders.
ART. 2: CONCLUSION OF THE AGREEMENT, LANGUAGE OF THE AGREEMENT, ORDERING STEPS, SAVE THE AGREEMENT
The presentation of goods on the internet does not mean that a binding agreement has been concluded with DBP Plastics N.V. The agreement between customers and DBP Plastics N.V. is concluded because DBP Plastics N.V. accepts an assignment from a customer. A confirmation of the order received does not mean that the order has been accepted. In that case, DBP Plastics N.V. sends an order confirmation via email. Sending the ordered goods to the customer means that the order has been accepted.
The language of the agreement is Dutch
The customer can place an order in the Amuse webshop by following the following steps:
By clicking on the product of your choice and adding it to the shopping cart. The customer can view all items placed in the shopping cart by clicking on "view your shopping cart or your shopping cart". Here the customer can remove items, change the quantity and view the shipping costs.
When the customer wants to buy the items in the shopping cart, he or she clicks "order" to go to the ordering process.
Customers who have already registered with Amuse and have not yet registered can register with their registration details. New customers are requested to enter their order details and log in or continue as a "guest".
Via the button "register" or "register" or "continue as a guest", the customer continues to the payment methods. Here the customer can choose from different payment methods.
Before the order is shipped, the customer will first arrive at the checkout page after clicking "Continue". On this page, all data (in particular invoice and delivery address, product, price, number, payment method of the order are displayed in an overview. The data can now be corrected or changed.
The order is sent via the button "order now". The customer thus concludes a binding purchase agreement. More information about the time stop of the conclusion of the agreement can be found under the first paragraph of this point. You can find more information about the ordering process on the 'help and support' page.
The agreement is not stored by DBP Plastics N.V. and can no longer be called up by the customer after the ordering process has been completed. The order details and the right of withdrawal are added in text form to the order confirmation, which can be printed by email after receipt. DBP Plastics N.V. stores the customer's order data. If the customer loses the documents of his order, he can contact DBP Plastics N.V in writing, by telephone or by email. DBP Plastics N.V. will then send a copy of the order details to the customer.
The consumer is the end consumer and may not be resold in any way.
ART. 3: PAYMENT TERMS
The customer can pay by bank contact, via PayPal or with a credit card.
If the issuer of your card refuses to agree to your payment to us, we cannot be held responsible for delays in delivery or non-delivery of your order. Orders without valid payment in the name of the registered cardholder will not be accepted or processed. Please note: minors (under 18 years of age) are not allowed to purchase unless they have permission from their parents or guardian.
Payment by credit card with SecureCode
If the customer chooses to pay via credit card with SecureCode (American Express, Visa and MasterCard), the goods are sent directly to the customer. The money will be debited from the credit card after the order confirmation has been sent to the customer.
Payment via PayPal
When paying via PayPal, the order will be sent no later than two working days after the amount has been transferred to PayPal.
ART. 4: PRICES AND SHIPPING COSTS
The prices at the time of the order are valid. All prices that are given away in euros (€) and are gross prices, i.e. the prices include VAT and other price components and do not include shipping costs. There is a minimum order amount of 30 €.
The amount of the delivery and shipping costs are calculated from the location of the logistics partners of DBP Plastics NV. If goods are sent to a customer outside Belgium, the delivery and shipping costs increase based on weight or volume weight.
For shipments outside the EU there may be additional costs such as taxes and / or levies / import duties that the customer must bear himself.
ART. 5: DELIVERY AND SHIPPING CONDITIONS
Ordered goods are delivered as soon as possible in accordance with the requested delivery method at the specified address. Incorrect delivery addresses are the responsibility of the user and may lead to additional costs that will be recovered from the user. All delivery costs are subject to change without notice. All goods are delivered subject to their availability. The maximum delivery period is fourteen days, counting from the day after your order.
If we are unable to deliver your goods within fourteen days, we will notify you as soon as possible and inform you of the expected delivery date. If we are unable to deliver our products due to a storage fault, heating shortage or any other unforeseen circumstance, your order will be canceled and we will notify you. Then the refund of the canceled product (s) will follow. If we are unable to deliver the goods within fourteen days, you can also cancel the undelivered orders / products at any time after notification of a late delivery. If the payment has already been made, you will receive the full refund.
If the goods delivered by us were damaged during transport, do not correspond to the items listed on the delivery note or do not match the items you ordered, you must report this and return the items to us within fourteen calendar days after their receipt. If we do not receive such notice, the customer is deemed to have accepted the items as satisfactory. We cannot be held responsible for any consequential damage due to late delivery or non-delivery by the carrier that appointed the company. Our liability in such cases is limited to the value of the items shown to have not been received by the customer.
ART. 7: REGULATIONS ON DISTANCE SALES / RIGHT OF WITHDRAWAL
In accordance with the regulations on distance selling, you have the right to cancel or return any order that you have placed via the website within 14 calendar days, counting from the day after the delivery date. This does not apply to items that are personalized at your request.
To cancel an item, you can send us, DBP Plastics NV, Terbekehofdreef 25-29, 2610 Wilrijk, an unambiguous statement by email to email@example.com stating that you wish to exercise your right of withdrawal. Here you also notify us of your customer number and the order number of the order. You are expected to take care of the items and keep all original packaging. Used articles are not taken back. All items are returned at the expense of the customer. For products that were damaged or incorrectly delivered upon delivery, we refund the costs upon receipt of the items. After receipt of the items in their original condition with the original packaging, we will pay you all costs incurred, including delivery costs (with the exception of any additional costs resulting from your choice of a delivery method other than the cheapest standard delivery offered by us). back within 14 days after receipt of your cancellation notice.
ART. 8: RESERVATION OF PROPERTY
The goods remain the property of DBP Plastics N.V. until DBP Plastics N.V. has received full payment, including compensation of interest and costs.
The buyer may not tax, sell, resell, dispose of or otherwise encumber the products before ownership has passed.
ART. 9: FORCE MAJEURE
We are not responsible for any failure to fulfill our obligations if it is the result of, or is caused by, labor disputes or any other circumstances that are beyond the reasonable control of the Company, such as cases of force majeure, riots and disturbances, flooding, fire, technical failures, strike, lock-out, unexpected traffic jams, problems finding transport and passing laws. If, due to such circumstances, it becomes impossible for the company to deliver the ordered items in whole or in part within a reasonable period of time, the liability of DBP Plastics N.V. is limited to the value of the items not delivered, plus any associated delivery costs.
ART. 10: WARRANTY
DBP Plastics N.V. guarantees that the products comply with the order placed and meet the normal expectations that the Buyer may have, taking into account the specifications of the product. In addition, DBP Plastics N.V. ensures that the items ordered comply with all existing laws at the time of the order.
In the exceptional case that the quality of the delivery would nevertheless be affected, the Buyer must immediately provide proof of this immediately at the time of delivery. The Buyer always has an obligation to inspect the products carefully immediately upon receipt. Complaints of the Buyer, which relate to defects in the product or the delivery, which are visible externally (for example, if the products would not be safe, or were damaged during transport), must therefore be communicated IMMEDIATELY by the Buyer to DBP Plastics NV be notified by e-mail within 4 hours of receipt.
If you have received a product in a damaged condition, please notify us first. You can contact us at firstname.lastname@example.org. We look at how we can offer a solution and will ask you to return the item. The return costs will be refunded in this case (according to standard postal rates). Send the damaged product together with the return form and a description of the damage. Be sure to add your account number so that we can make the refund.

The website is offered to you without any explicit or implicit guarantees regarding its correct functioning. DBP Plastics N.V. is not liable for damage resulting from the use of the Website, regardless of whether it turned out to be correct or incorrect, or for damage caused due to incorrect, incomplete, ambiguous or dated content or language errors on the Website.
DBP Plastics N.V. is in any case only liable for compensation of the amount of the order in question

We make every effort to protect the safety of the users of our online webshop. We use SSL technology to secure your data with us during all sales transactions. All information you provide is fully encrypted so that third parties cannot read it. You can recognize a secure SSL connection by the “lock” in the bottom status bar of your browser.
ART. 14: COMPLAINTS / DISPUTE RESOLUTION
DBP Plastics NV does everything to satisfy its customers 100%. If the buyer does have complaints about its services and / or products, it can contact DBP Plastics N.V. by email at email@example.com
All disputes regarding the concluded agreement are governed by Belgian law and only the court of Antwerp has jurisdiction to hear them.

The contents of this website and other publications of DBP Plastics N.V are the property of DBP Plastics N.V. or are used with the permission of the owner. Reproduction is strictly prohibited unless with permission.
